Dutch judges have issued a preliminary injunction against a European compounding firm, forcing an immediate halt to sales of an unauthorized semaglutide nasal spray.

The District Court of The Hague on Wednesday ruled in favor of Novo Nordisk AG (NYSE:NVO), determining that Ceban Ziekenhuisfarmacie B.V. infringed upon the healthcare company's supplementary protection certificate for semaglutide.

The legal judgment serves to protect patients from unapproved drug formulations and reinforces standard European safety regulations.

Court Forces Inventory Removal And Disclosure Of Supply Chains

Under the injunction, Ceban must immediately stop all infringing sales and remove references to the semaglutide product from relevant websites and listings.

The court also ordered Ceban to provide Novo Nordisk with complete details regarding its commercial supply chain and to fully reimburse the drugmaker's legal expenses.

Unapproved Compounded Formulations Lack Regulatory Validation

Compounded medicines represent pharmacy-prepared formulations that have not received review or authorization from regulatory agencies such as the European Medicines Agency or the U.S. Food and Drug Administration.

Because these products do not undergo formal clinical trials, they lack proven standards for consistent manufacturing, quality, safety, or clinical efficacy.

Novo Nordisk's approved semaglutide medicines are Wegovy, Ozempic, and Rybelsus.

Currently, no regulatory body worldwide has approved a nasal spray formulation of semaglutide, and Novo Nordisk does not manufacture, distribute, or endorse compounded versions.

Legal Battle Comes Amid Broader GLP-1 Disputes

The ruling comes as Novo Nordisk continues to aggressively defend its GLP-1 franchise through litigation.

In July, the company sued Eli Lilly and Co. (NYSE:LLY) in the U.S. District Court for the District of New Jersey, alleging deceptive marketing related to its obesity and diabetes drugs Zepbound and Mounjaro.

The lawsuit, filed in the U.S. District Court for the District of New Jersey, accuses the competitor of violating both state and federal false advertising and unfair competition laws.

The core of the dispute centers on nationwide consumer campaigns for Zepbound and Mounjaro. The plaintiff claims that the advertisements are materially misleading to millions of patients managing obesity and type 2 diabetes.
